unit 3 assignment 18

Task 1

A case brief is an organized, written summary of the essential elements of a judicial opinion. They are useful tools to assist you in learning to analyze the law. To brief a case, you must first carefully read the assigned cases to gain an overall understanding of the facts of the case, the decision rendered by the court, and the reasoning behind the court’s decision. You will summarize what the justices said in the case. Write your brief as if you’re trying to explain your case to a classmate.

  • Address the following in 1,000–1,250 words:
    • Read and brief the following cases:
      • U.S. v. Bailey, 444 U.S. 394 (1980)
    • Your case brief should follow the format below:
      • Name of the case and citation:Title of the selected case
      • Facts of the case: Summary of the events, court timeline, evidence, and so forth
      • Legal issues: Issues that were present in this case
      • Court’s decision: The court’s decision and the conclusion to the case
      • Rationale: The reasoning behind the final decision (Why did the court rule this way?)
      • Dissenting opinions: Any disputing or disagreeing opinions with an explanation of what they were and why they were raised
  • Do you agree or disagree with the Court’s decision? Explain why you agree or disagree with the Court’s decision.
  • Your paper should include the definition of escape.

Be sure to reference all sources using APA style. Use at least 3 references for your paper.

Task 2

Intelligence and the USA PATRIOT Act

The Uniting and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism Act of 2001 (USA PATRIOT Act, or simply the Patriot Act) has generated a great deal of controversy since its enactment just weeks after the terrorist attacks of September 11, 2001. Critics argue that the Act was passed opportunistically and hastily after September 11, that it is too broad, and that some of its provisions go too far. Proponents of the Act, on the other hand, are concerned that it does not go far enough; however, its provisions have greatly enhanced information sharing in the law enforcement and intelligence communities.

You are an intelligence analyst for the Department of Homeland Security assigned to the Office of Intelligence and Analysis (DHS-OIA). As an intelligence analyst in the intelligence community, you participate in a law enforcement and intelligence working group. The working group consists of analysts and officers throughout the U.S. intelligence and law enforcement communities who meet monthly to discuss various topics relevant to homeland security. During a recent meeting, the topic of the Patriot Act came up for discussion and debate. As the representative from DHS-OIA, you were asked by your law enforcement peers for your opinion, from an intelligence community perspective, on the Patriot Act and whether or not you felt it has enhanced information sharing between the communities.

Primary Task Response: Within the Discussion Board area, write 400–600 words that respond to the following questions with your thoughts, ideas, and comments. This will be the foundation for future discussions by your classmates. Be substantive and clear, and use examples to reinforce your ideas:

  • Do you feel that the Act has enhanced information sharing between the U.S. law enforcement and intelligence communities? Why or why not?
    • Specifically, what advantages or disadvantages has each individual community experienced? Explain.
  • Does the Patriot Act infringe on American citizens’ constitutional rights? Why or why not?
    • Some feel that the Act is too broad, with little to no oversight. Do you agree? Why or why not?
  • What effects do you think repealing or significantly modifying the Patriot Act would have on information sharing between the U.S. intelligence and law enforcement communities? Explain.

Task 3

You are an intelligence analyst for the Department of Homeland Security assigned to the Office of Intelligence and Analysis (DHS-OIA). You have been asked by a local law enforcement agency to come and speak to its newly established law enforcement intelligence unit to provide a briefing on the U.S. Intelligence Community’s (USIC) intelligence process. Specifically, you have been asked to discuss in detail the similarities and differences (compare and contrast) between the USIC intelligence cycle and the law enforcement investigative process.

Assignment Guidelines

  • For this assignment, you must prepare a briefing in written form consisting of 2-3 pages. Your briefing should be designed for a law enforcement audience and should address the following:
    • In your own words, provide a definition of the U.S. intelligence cycle.
    • In your own words, provide a brief explanation of the purpose of the U.S. intelligence cycle.
    • What is the overall purpose of the law enforcement investigative process? Explain.
    • What are the steps of the law enforcement investigative process? Explain.
    • How does the U.S. intelligence cycle compare with the law enforcement investigative process?
      • How is the U.S. intelligence cycle similar to the law enforcement investigative process? Explain.
      • How is the U.S. intelligence cycle different from the law enforcement investigative process? Explain.
  • Compile your responses in the final briefing, and submit the file to your instructor.
  • Be sure to reference all sources using APA style.
