The permissible exposure limit (PEL) tables in 1910.1000 reflect a set of consensus standards that were in existence in 1969. The Occupational Safety & Health Administration (OSHA) tried to update them in the late 1980’s and early 1990’s to a more recent version but lost the battle in court following promulgation of the final rule. The existing recommendations from the National Institute of Occupational Safety and Health (NIOSH) and the American Conference of Governmental Industrial Hygienists (ACGIH) are now as much as 100 times lower on some contaminants, but OSHA cannot enforce NIOSH or ACGIH levels if OSHA has its own published PEL.
